Athlete Agent Law FAQs

Who is an Athlete Agent?

An individual who enters into an agency contract with a student athlete or, directly or indirectly, recruits or solicits a student athlete to enter into an agency contract. The term includes an individual who represents to the public that the individual is an athlete agent. The term does not include an individual acting solely on behalf of a professional sports team or professional sports organization.

Who is a Student Athlete?

An individual who engages in, is eligible to engage in, or may be eligible in the future to engage in an intercollegiate sport. If an individual is permanently ineligible to participate in a particular intercollegiate sport, the individual is not a student athlete for purposes of that sport.

How Do I Become a Registered Athlete Agent?

Application forms are located on the Department's website. No bond or criminal background check is required.

The Department will also accept application forms that have been filed in other states if the application:

  • was submitted in the other state within six months preceding the submission of the application in this State and the applicant certifies that the information contained in the application is current;
  • contains information substantially similar to or more comprehensive than that required in an application submitted in this State; and
  • was signed by the applicant under penalty of perjury.

NOTE: Fees for out-of-state registration are different (see below). 

What are the Required Fees?

  • Initial License: $1,500
  • Renewal License: $700
  • Initial License based on Certificate of Registration issued by another state: $2,500
  • Renewal License based on Certificate of Registration issued by another state: $1,000

Can I Act as an Athlete Agent if I Have Not Registered?

An Athlete Agent may not contact athletes until they register, but the student can make the first contact with the agent. If the student initiates the communication, the agent must register within seven days after acting as an “agent”. At no time can an unregistered agent enter into a contract with a student.

Does the Department Issue Temporary Licenses?

While your application is pending, the Department may issue a temporary license.

When Must I Renew My Registration?

Certificates of Registration must be renewed every two years. Submit renewal applications at least 45 days prior to the expiration date. Renewals submitted after the expiration date must file as a new agent.
